license classifications

(NCAC Title 21 Chapter 12A .0202)

contractor

This classification includes all building construction and demolition activities, including: commercial, industrial, institutional, and residential construction. Includes parking platforms; all site work, grading and paving parking lots, sidewalks, sidewalks and gutters; storm drain, retaining or privacy walls, and construction fixtures and fittings; and indoor and outdoor recreational facilities, including natural and artificial sports fields, running tracks, bleachers, and seating. It also covers work classified in professional classes S (Concrete construction), S (Insulation), S (Interior works), S (Ship construction), S (Masonry construction), S (Roof), S (Metal assembly). , S (Swimming pools) and S (asbestos) and S (wind turbine).

housing contractor

This classification includes all construction and demolition activities related to the construction of residential units that must comply with the housing code adopted by the Building Code Council in accordance with GS 143-138; all site works, sidewalks, driveways, and water and sewer systems associated with the above structures and improvements; and the works carried out in the aforementioned dwellings in the special classifications S (Insulation), S (Interior Works), S (Masonry), S (Roofs), S (Swimming pools) and S (Asbestos).

This classification includes all road construction activities, including: grading, paving of all kinds, installation of artificial outdoor sports surfaces, laying of public and private service lines as a complement to a large project, construction and repair of bridges, construction and gutter repair, parking decks, sidewalks, curbs, gutters and drainage. It also includes the installation and assembly of protective barriers, fences, signs and additional road equipment; includes the paving and grading of runways at airports and airfields, taxiways and parking lots, including the installation of fencing, marking, lighting and marking of runways; and works carried out in the special classifications S (boring and excavation of tunnels), S (concrete construction), S (ship construction), S (railway construction) and H (grading and excavation).

utility contractors

This classification includes works that are the execution of civil works in aqueducts and sewers and in the subclassifications of facilities included in the S.G. 87-10(b)(3). The Board grants a license to a utility contractor based on one of the terms set forth in G.S. 87-10(b)(3) for which the contractor is qualified. The public service license covers works carried out in the special classifications S (drilling and opening of tunnels), PU (communications), PU (fuel distribution), PU (electrical - before the transfer point), PU (water pipes and sewerage). , PU (water treatment and sanitation) and S (swimming pools).

specialist contractor

This classification includes all civil works and the execution of contracts described inRule 0.0202.

Limited License

The limited licensee is authorized to act as general contractor on any individual project valued up to seven hundred fifty thousand dollars ($750,000), excluding cost of ownership and all incidental property improvement costs. (GS87-10(a1)

An applicant for a limited license must: (NCAC Title 21 Chapter 12A .0204)

(1) the requirements according to G.S. comply with 87-10 and section .0400 of this chapter;

(2) have current assets in excess of total current liabilities by at least seventeen thousand dollars ($17,000), or a total net worth of at least eighty thousand dollars ($80,000);

(3) be approved in the exam, which must deal with matters related to the specific classification of the contract chosen by the bidder, with points in accordance with rule .0404 of this chapter; AND

(4) if the applicant or any owner, principal, or entitled person is bankrupt or is in bankruptcy within five years prior to the filing of the application, provide the Board with a report of the agreed upon procedures on a form provided by the Board or audited financial statements with balance classified as part of the request. This requirement does not apply to shareholders of a publicly traded applicant company.

intermediate license

The holder of a provisional license is authorized to act as general contractor on any individual project valued up to one million five hundred thousand dollars (US$1,500,000), excluding land costs and all incidental land improvement costs. (GS87-10(a1)

An applicant for a temporary license must: (NCAC Title 21 Chapter 12A .0204)

(1) the requirements according to G.S. comply with 87-10 and section .0400 of this chapter;

(2) Have current assets in excess of total current liabilities of at least seventy-five thousand dollars ($75,000), as reflected in an agreed process report on a form provided by the Board of Directors or audited financial statements prepared by a public authority certified accountant or an independent accountant engaged in the practice of public accounting; AND

(3) be approved in the exam, which must deal with matters related to the specific classification of the contract chosen by the bidder, with a grade in accordance with rule .0404 of this chapter.

unlimited license

The holder of a perpetual license has the right to act as a general contractor without limiting the value of a single project. (GS87-10(a)(1)

An applicant for a perpetual license must: (NCAC Title 21 Chapter 12A .0204)

(1) the requirements according to G.S. comply with 87-10 and section .0400 of this chapter;

(2) Have current assets in excess of total current liabilities of at least one hundred fifty thousand dollars ($150,000), as reflected in an agreed process report on a form provided by the Board of Directors or audited financial statements prepared by a certified public accountant or a freelance accountant engaged in the practice of public accounting;

(3) pass the exam, which must include topics related to the specific classification of the contract chosen by the bidder, with a score in accordance with rule 0.0404 of this chapter

In lieu of proving the working capital value, an applicant for a perpetual license may provide a bond of $1,000,000. Details of the mandatory requirements are outlined in the NCAC Rule, Title 21, Chapter 12A .0204e

guarantee

(e) Warranties. Instead of demonstrating the amount of working capital in accordance with subparagraph (c)(2) and (d)(2) of this rule or net assets in accordance with subparagraph (b)(2) of this rule, an applicant may obtain a bond from a bondsman designated pursuant to GS 58 sections 7, 16, 21, or 22 authorized to conduct bondsman business in North Carolina. The guarantor must have a rating of A.M. Best or its successor organization rated Superior (A++ or A+) or Excellent (A or A-). The bond shall be unbroken in form and effect as long as the applicant maintains a North Carolina general works license or until the applicant demonstrates the necessary working capital pursuant to subparagraph (c)(2). and (d)(2) of this Rule. The applicant must provide evidence of a security deposit that meets the requirements of this policy with the application form and subsequent Annual License Renewal forms. The applicant shall retain a deposit of one hundred seventy-five thousand dollars ($175,000) for a limited license, five hundred thousand dollars ($500,000) for a temporary license and one million dollars ($1,000,000) for a perpetual license. The bond must list the State of North Carolina as creditor and be in favor of any person aggrieved by an act or omission of the applicant that constitutes a breach of a construction contract, a breach of a contract to supply labor, materials, or the applicant's professional construction services or for the applicant's tort or omission in the performance of a construction contract. The deposit required by this rule is in addition to and does not replace any other deposit required by the applicant by law, regulation or any part to which the applicant is a party. If the sponsor terminates the sponsorship, the sponsor and applicant must notify the Board in writing within 30 days. If the applicant does not provide written proof of financial responsibility under this rule within 30 days of termination, the applicant's license will be suspended until written proof of compliance is provided.
